1. Agreement to Terms
By accessing or using the Claim Trove DBA Carrier Search Engine (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by Claim Trove LLC ("we," "us," or "our").
2. Description of Service
Claim Trove is an AI-powered search engine designed to identify potential Defense Base Act (DBA) insurance carriers based on historical Department of Labor (OWCP) data, public contract records, and coverage card FOIA logs. The Service inputs non-identifiable data (Location, Date, and Employer) to generate a Carrier Identification Report.
3. Data Accuracy & Limitations
While this AI-driven engine aims for 98% accuracy by utilizing historical data and Department of Labor (OWCP) coverage records, the results are for informational purposes only.
Carrier identification is based on predictive modeling and does not constitute a legal determination of coverage. Results may vary based on specific contract modifications or carrier shifts not yet reflected in public records. Past performance and data do not guarantee future case outcomes. To confirm specific coverage, you should consult with a qualified legal professional.
4. No Legal Advice
The Service does not provide legal advice, and nothing in the Service or any report generated by the Service should be construed as legal advice. The Service provides information from public DOL records and other publicly available data sources. You should always verify information with primary sources and consult with a qualified attorney before making legal decisions.
5. No Guarantee of Outcomes
Past success in identifying carriers or resolving claims does not guarantee a similar outcome for your specific case. Each Defense Base Act claim is unique and subject to the Longshore and Harbor Workers' Compensation Act (LHWCA) standards (33 U.S.C. §§ 901–950). The Service identifies likely carriers based on historical patterns, but actual coverage determination is made by the responsible government agency and/or the courts.
6. Acceptable Use & PII Prohibition
This tool is designed to be HIPAA and PII-compliant. By using the Service, you agree to the following:
- Prohibited Inputs: You are strictly prohibited from inputting Personal Identifying Information (PII) such as Social Security Numbers, full birth dates, home addresses, phone numbers, or specific medical records.
- Permitted Inputs: The data you provide (Location, Date, Employer Name) must be non-identifiable business information related to contract identification.
- Your Responsibility: You are solely responsible for ensuring that no PII is entered into the system.
- No Scraping: You may not use automated tools, bots, or scrapers to extract data from the Service. Unauthorized scraping or derivative use of the data is strictly prohibited.

7. User Consent
By using this tool, you agree that the data you provide is for the purpose of identifying potential insurance coverage under the Defense Base Act. You acknowledge that you have read and understand these Terms of Service and our Privacy Policy, and you consent to the collection and processing of the non-identifiable data you submit.
8. Intellectual Property & Proprietary Data
This software and the resulting data reports were developed entirely at private expense. The Service contains proprietary logic including, but not limited to:
- Fuzzy logic mapping of employer name variations to verified parent entities
- Specific OWCP carrier code matching by contract year
- Geospatial normalization of base/installation names into regional identifiers
- Temporal gap analysis bridging missing coverage dates using litigation trends
- Functional translation linking contract numbers to mission types
While raw FOIA data is public, the selection, coordination, arrangement, and transformative logic applied to that data constitutes original intellectual property protected under U.S. Copyright Law.
9. Generated Reports
Reports generated by the Service are proprietary search results intended for your internal use only. Each report identifies likely insurance carriers based on historical Department of Labor (OWCP) data and coverage card FOIA logs. Reports are not official government documents and do not constitute a legal determination of coverage. You may share reports with colleagues and clients in the normal course of legal practice, but you may not resell, redistribute, or create derivative products from the report data.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Claim Trove LLC and its agents, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction.
